Privacy Policy

Last updated: September 26, 2026

Tony Babarino operates TonyBabarino.com to provide real estate information and respond to inquiries about buying and selling property in Irvine and Orange County. This policy explains how I collect, use, and disclose information through this website and in connection with my real estate services. A brokerage, lender, title company, or other party involved in a transaction may have its own privacy practices and notice.

Information I collect

Information you provide. When you contact me, submit a form, request information, subscribe to emails, or work with me, I may collect your name, contact details, the information in your message, property interests, and information relevant to the services you request. During a real estate transaction, I may receive additional documents and information through transaction channels used by the parties involved.

Information collected through the website. The website and its service providers may process your IP address, approximate location derived from it, browser and device details, pages viewed, referring page, dates and times of visits, interactions, and cookie or similar identifiers. The information collected depends on the services loaded and your privacy choices.

Information from others. In providing real estate services, I may receive relevant information from your authorized representatives, my brokerage, other agents, transaction participants, and public property records.

How I use information

I use information to answer inquiries; provide real estate services; communicate about properties, appointments, and transactions; send email updates when you subscribe or as otherwise permitted; operate and protect the website; understand website use; keep business records; and comply with legal and professional obligations.

Website newsletter signups use Kit (formerly ConvertKit). If you subscribe to marketing emails, you can unsubscribe using the link in an email or contact me. Unsubscribing from marketing does not stop messages needed to respond to an inquiry or manage an existing relationship or transaction.

Cookies, analytics, and other website technologies

Necessary technologies support website functions such as security and remembering your privacy choices. The site also uses the following services:

  • Google Analytics, installed through Google Site Kit, measures website use. Google’s consent controls are enabled. The Google tag may send limited requests to Google before you make a Statistics choice, including the page visited and browser information, even when analytics cookie storage has not been authorized. Selecting Statistics allows additional analytics functions, including analytics cookies.
  • Clicky and Microsoft Clarity are used to understand visits and page interactions. Both can send visit information before you make a cookie choice and after you select Deny. Clarity may include session replay and interaction data. Clicky’s Visitor Privacy setting is applied to all visitors to anonymize IP addresses and disable its tracking cookies.
  • Embedded content, such as videos, may connect to its provider when you choose to view it. That provider may collect information under its own privacy policy.
  • A Google News publisher script is present on the site. Its specific function and data processing are under review. Loading an external script can disclose technical request information, such as an IP address, to its provider.

Google Search Console and PageSpeed Insights are connected for website management. Third-party providers have their own privacy notices. Website services and their configuration may change; I will update this policy when a material change affects the practices described here.

On a new visit, the cookie banner may offer Accept, Deny, and View preferences. You can revisit choices through Manage Consent or Opt-out preferences on the site. Denying optional categories prevents the services that require those categories from loading through the site’s consent controls, but does not necessarily prevent the limited Google tag requests described above. You may also control cookies in your browser; restricting necessary storage may affect site functions.

Browser privacy signals and opt-out requests

Global Privacy Control (GPC) is a browser signal that can communicate a request to opt out of the sale or sharing of personal information where applicable law recognizes that signal. It differs from the older Do Not Track setting. The site’s consent system is configured to recognize GPC, but testing has shown inconsistent cookie-banner display when GPC is enabled. I am reviewing that behavior with the consent provider. A missing banner should not be treated as a request for your consent.

While that issue is being reviewed, you can use Deny or Opt-out preferences on the site and contact me using the details below to make a privacy request, including a request to opt out of any sale or sharing that may apply. I will handle applicable requests as required by law. I do not treat the older Do Not Track signal as a guarantee that every website technology is blocked.

When information is disclosed

I may disclose information to providers that help host, secure, analyze, and operate the website, process forms, and send requested emails; to my brokerage and people or organizations involved in providing requested real estate services; and when required by law or reasonably necessary to protect rights or security. A link to another website does not make its practices part of this policy.

I do not sell a list of client contact details. Some uses of advertising or tracking technology may count as a “sale” or “sharing” under certain state privacy laws even when no money changes hands. Use the site’s opt-out controls or contact me to request an applicable opt-out. This statement does not assume that every third-party disclosure is a sale or sharing.

Retention and security

I keep information for as long as reasonably needed to provide services, manage inquiries and relationships, maintain business and transaction records, resolve disputes, and meet legal obligations. The period depends on the record and the reason it is kept. I use reasonable measures intended to protect information, but no electronic system is completely secure. For transaction documents containing sensitive financial or identity information, contact me about the appropriate transaction channel.

Your privacy choices and requests

You can contact me to ask about personal information I hold or request access, correction, deletion, or another choice available under applicable law. I may need to verify your identity before responding. Some records may be retained when an applicable exception permits or requires it, including for transaction records, legal obligations, or security.

California residents may have rights under the California Consumer Privacy Act when it applies to the relevant business and information. These can include rights to know, delete, correct, opt out of sale or sharing, limit certain uses of sensitive personal information, and receive non-discriminatory treatment for exercising applicable rights. Other state laws may provide additional rights where they apply. You can make a request using the contact details below; an authorized agent may also contact me on your behalf, subject to appropriate verification.

Children

The website is intended for people seeking real estate information and services and is not directed to children under 13. If you believe a child has provided personal information through the site, please contact me.

Changes to this policy

I may update this policy when my services, website technologies, or legal obligations change. The date at the top identifies the latest revision. I will provide additional notice when required by law.
